New! Legal Analysis: Association of Faith-Based Organizations v. U.S.
Department of Labor

Geneva College, a Christian school in western Pennsylvania, and the Association of Faith-
Based Organizations have sued the U.S. Department of Labor and several Pennsylvania
officials over the exclusion of the college from the state's Internet job listings. The case
involves an issue of concern to many faith-based organizations – whether they can base their
hiring decisions on religion, and still receive government support.

The state gets federal money for the listing service under the Workforce Investment Act, which
forbids religious discrimination in hiring. Because Geneva College requires all employees to
declare their commitment to Jesus Christ, the state refused to run the college's advertisements
for new employees. The suit alleges that this exclusion violates the First Amendment and the
Religious Freedom Restoration Act.

In this analysis of the case, Ira C. Lupu and Robert W. Tuttle, co-directors of legal research for
the Roundtable, conclude that the college and AFBO “face an uphill fight.” Both the federal and
state governments have good reason for the broad nondiscrimination provisions in the
Workforce Investment Act that prompted the college’s exclusion from the job listing, they argue.
And the exclusion does not greatly impact the college’s hiring practices or religious freedom,
Lupu and Tuttle conclude.

New! An Interview with Rev. Blake Rider, Christ Episcopal Church,
Poughkeepsie, NY

Rev. William Blake Rider is the rector of Christ Episcopal Church in Poughkeepsie, N.Y. He was
named in a recent Poughkeepsie Institute report on faith-based organizations as one of a group
of new “outgoing, community-minded, collaboration-seeking” religious leaders who “constitute
new possibilities for hope” in the Hudson River Valley city of about 45,000 people.

Rider, an Oklahoma native, felt the call to ministry after spending 20 years in the oil industry, and
was involved in social service work in Houston as a lay person. He was a priest at a large
Episcopal cathedral in Houston before deciding to lead Christ Episcopal Church.

Weekly Digest of Federal Grants with Faith-Based and Community
Organization Eligibility

The grant opportunities this week for community and faith-based organizations are through
programs administered by U.S. Department of Education, the U.S. Department of Health and
Human Services and the U.S. Department of Justice.

Potential applicants should be aware that some grant programs may require specific technical
expertise, or experience in particular foreign countries.
